Why the “one UAE Will” answer is too simple

Estate planning for an expat is a coordination problem. A Dubai property, an Abu Dhabi asset, a UAE bank account, shares in a company, children living in another country and a spouse with a different nationality may create different evidence and jurisdiction questions. The correct route depends on the document, the registry and the asset—not on a marketing label.

The UAE Government explains that personal-status and inheritance rules can depend on nationality, religion and the applicable federal or emirate framework. Non-Muslim civil-personal-status options exist, but they do not remove the need to identify the correct Will and probate route for the actual family and assets.

Map the estate before choosing the document

  1. List assets: property, bank accounts, brokerage, company shares, vehicles and valuable personal assets.
  2. Identify the registered owner: personal, joint, company, foundation or nominee arrangements require different review.
  3. Separate guardianship: children, guardians and substitute guardians need their own instructions and evidence.
  4. Check countries: foreign assets and continuing connections may require local wills or advice.
  5. Confirm execution: language, translation, witnesses, notarisation and registry requirements must be current.
  6. Plan probate: the executor and family should know which authority receives the application after death.

What a Will does not guarantee

A Will does not guarantee that a bank will release funds without its process, that a foreign court will accept UAE wording, that a company’s constitutional documents are aligned, or that guardianship will be decided without the court considering the child’s welfare and applicable law. It also does not replace lifetime powers of attorney, asset ownership review, tax advice or succession planning for a business.

Keep the Will, title deeds, account details, corporate records, marriage and birth certificates and contact details for the executor in a controlled place. Review after marriage, divorce, birth, death, relocation, property purchase, company restructuring or a change in the law.

Do expats need a UAE Will?

A UAE Will can help an expat state wishes for assets or guardianship, but whether one is appropriate depends on religion, nationality, assets, family circumstances and the applicable law. A qualified wills lawyer should draft or review the document.

What is the difference between a DIFC Will and an ADGM Will?

They are separate routes with different registries, rules, service channels and jurisdictional connections. DIFC Courts operate the DIFC Wills Service and Registry; ADGM Courts’ Notary Public and Wills Office offers notarisation of non-Muslim Wills, while probate applications go to the Abu Dhabi Judicial Department’s Wills and Probate Office.

Does a UAE Will cover property in Dubai?

Potentially, if the chosen route and document cover the asset and the relevant authority accepts it. Confirm the exact property, title, beneficiary and probate position before relying on a Will.

Can an expat include bank accounts and shares?

The Will must describe the intended estate and the relevant institutions or assets. Banks, registrars and courts may require their own documents and probate steps; a Will does not itself transfer an account or shareholding.

Can a Will appoint guardians for children?

Some UAE Will routes allow guardianship provisions, but eligibility, wording and enforcement depend on the chosen registry and family facts. Guardianship is not the same as inheritance and needs separate legal attention.

Does a Will avoid UAE probate?

No. A Will may provide instructions and a route for proving them, but probate or court/authority procedures may still be required. The process depends on the registry, asset and jurisdiction.

Can a non-Muslim use a DIFC or ADGM Will?

These services are designed for eligible non-Muslim applicants, but criteria and permitted purposes differ. The official registry should be checked for current eligibility before drafting.

Does a UAE Will control assets outside the UAE?

Not automatically. ADGM states that a Will may refer to assets outside the UAE, but probate is granted in the jurisdiction where those assets are located. Local advice is required in each country.

What happens if I have no UAE Will?

The applicable UAE and foreign-law rules, court jurisdiction and family facts determine the result. Do not rely on a headline claim that a new default rule always produces a fixed 50/50 outcome.
